Lawrence E. Feldman & Associates is currently investigating claims involving injury/death resulting form the use of the Ventak Prizm 2 Model 1861 defibrillator manufactured by Guidant Corp. According to the New York Times article, the company knew about the defective condition of this device but failed to warn doctors about the failure rate because the company considered the failure rate to be low. One 21 year old college student has died as a result of the electrical flaw in the device that causes it to malfunction and short circuit. After the young man's death, Guidant told his doctors that it was aware of 25 other cases in which the defibrillator, a Ventak Prizm 2 Model 1861, had been affected or disabled by the same electrical flaw.

On June 10, 2005, Lawrence E. Feldman & Associates filed a lawsuit against Guidant Corporation in federal court in Minnesota, on behalf of a class consisting of all persons who were implanted with a Guidant Corp. Ventak Prizm 2 Model 1861 defibrillator (the “Ventak Prizm Defibrillator”) manufactured prior to November 2002, excepting those individuals whose Prizm Defibrillator has malfunctioned (the “Class”). Plaintiff brings this action to recover damages, restitution, refunds, and/or for equitable, injunctive and declaratory relief, including medical monitoring, against Guidant, which designed, manufactured, tested, marketed, distributed, promoted, and sold the Ventak Prizm Defibrillators.

Boston Scientific Corp. will pay $195 million to settle a class-action suit against its Guidant division, ending a legal battle in which patients claimed Guidant Corp. knowingly hid defects in its implantable heart devices.
After negotiating with a magistrate judge, the two sides reached an agreement in federal court in Minnesota. The case had been set to go to trial July 30 . |

| Boston Scientific is currently involved in 1,600 product-liability lawsuits related to claims involving the Model 1861 defibrillator. The issue concerns a flaw that could cause the Model 1861 defibrillator not to produce a life-saving jolt. Guidant Corp. (purchased by Boston Scientific in 2006) discovered this flaw in 2002, but did not warn patients until the recall in 2005. This flaw proved fatal for three patients. |
